Depending on various circumstances, such as prior criminal history, a defendant may receive a lighter penalty. A person can be put on probation for up to three years after being convicted of petty theft. If theft involves an item worth less than $50 and the defendant has no prior theft history, they may only receive an infraction, with the maximum fine of $250.

On the other hand, grand theft charges apply when stolen property exceeds the value of $950 or when the type of theft automatically leads to grand theft charges. Irrespective of the item value, grand theft charges apply to stolen items, such as firearms or cars. The classification of grand theft depends on the item value, with some cases being considered as misdemeanors, while others are considered felonies. In the case of misdemeanor grand theft, a defendant may face a sentence of a maximum of 364 days imprisonment or a fine of up to $1000 or both, and probation of up to three years. Felony grand theft charges may result in a sentence of 16 months, two years, or three years, along with a fine of up to $10,000.
