California: Understanding Marijuana Laws and the Sale of Marijuana to Minors
California is notorious for having one of the most controversial marijuana policies in the country. Being one of the states with the most liberal policies on how consumers can have access to marijuana, California stands out in contrast to other states. However, there are still critical restrictions to marijuana use and distribution that you need to be aware of, especially when traveling or residing in California.
Prohibited Actions
As stated in California Health and Safety Code 11360, it is illegal to sell, give away, transport for sale or import any amount of marijuana in California. However, things get more complicated when a minor is involved in marijuana transactions.
Sale of Marijuana to Minors
California Health and Safety Code 11361 governs the sale of marijuana to minors, making it a felony for anyone who is 18 years or older to sell marijuana to minors. In addition to selling, it is also illegal to use a minor for carrying, administering, selling, furnishing, giving away, peddling or preparing any amount of marijuana for unlawful purposes.
Penalties
The consequences of involving a minor in marijuana transactions are severe. The punishment for recruiting a minor under the age of 14 years is more severe, ranging from three, five to seven years in a California state prison. On the other hand, when the minor involved is over 14 years but less than 18 years old, the penalty is still substantial, with punishment ranging from three, four to five years served in a California state prison.
