The prosecutors at the Ventura County District Attorney’s Office are known to be rather tough on criminal defendants.  On top of that, members of the available jury pool are largely affluent, white, conservative and pro-prosecution.  This spells high conviction rates and excessive jail sentences, even for some relatively minor DUI and criminal offense cases.


The Ventura Criminal Court Process

Generally speaking, people who get arrested and booked in Ventura get the opportunity to bail out or get released on their own recognizance. The next important court date is the arraignment.  This is the hearing in which the judge formally reads the criminal charges in open court.

A defendants who cannot hire private counsel is required show up in person for their arraignments.   In some cases, a private attorney can appear in place of the defendant, while in other cases, defendants are still required to appear even if they have their own attorney.

Missing any court appearances will trigger the issuance of a bench warrant by the judge for the defendant’s arrest.  The court will not recall the bench warrant until the defense files a motion to quash the warrant and appears in person at a court hearing.

A defendant would be denied bail if they are considered a flight-risk, a public safety risk, or are facing very serious charges.

When defendant is unable to retain their own lawyer, the court will assign a public defender to handle their case.  Public defenders are severely overworked, with piles of cases to see about.  It is not unusual for public defenders and their clients to have no communication outside of the courtroom.  Having a private lawyer puts the defendant at an advantage.

Once the arraignment is over, the defense attorney begins to negotiate a plea deal with the prosecution. The District Attorney is frequently willing to offer a reduction of the charges or even dismissal as a way to avoid going to trial. If the case does proceed to trial, a rare circumstance, the burden is on the prosecutor to demonstrate guilt beyond a reasonable doubt.


Should the defendant agree to enter a plea, or if the defendant is found guilty at trial,  the next step is for the judge to hand down a criminal sentence. Standard penalties include a fine and jail time.  Some defendants may be able to avoid incarceration if they get granted probation.
