If the accused is more than 21 years of age and convicted of felony statutory rape and the minor is younger than 16, there could be a penalty of up to $25,000 and four years in jail.

California Penal Code 261.5 PC only stipulates sexual intercourse between the accused and the minor. Other sexual acts such as oral sex or sexual contact with a minor under the age of consent are illegal, but other laws address them. Additionally, spouses of individuals younger than 18 years of age cannot be charged for statutory rape.
