There is also no juvenile delinquency courthouse in Santa Clarita.  All Santa Clarita’s juvenile infractions–such as truancy, skateboarding, tobacco possession and curfew violations–are handled at the Santa Clarita Community Court.  Santa Clarita’s juvenile criminal cases are usually heard at the Sylmar Juvenile Courthouse.

The Criminal Justice Process

For the most part, people who get arrested are eligible to be released on bail or their own recognizance (OR Release).   Be aware that as a condition of being released, defendants are obligated to appear at their future court dates.   A private defense attorney may be able to appear in his or her client’s stead, depending on the case.   Defendants who fail to appear for their court dates risk getting a bench warrant issued for their arrest.

For defendants that remain in custody following their arrest, our lawyers fight for a lower bail. As soon as the defendant gets charged at their arraignment, the defendant’s attorney and the prosecutors begin to work trying to come to a plea agreement.  Both attorneys generally prefer to avoid the time and trouble of trial.  Therefore, prosecutors may be willing to reduce or dismiss charges.

Generally speaking, private attorneys tend to get offered better plea deals than public defenders.


In felony matters, defendants are entitled to a preliminary hearing, unless a grand jury indicted them.  The purpose of “prelims” is for the judge to make sure that the prosecution has sufficient evidence to move forward with pressing charges. If there is not enough evidence, the charge will get dismissed.

In the event that the defendant ultimately chooses to take a plea, the judge will more than likely sentence him or her to whatever terms the defense attorney and prosecutor agreed to.  In many situations, plea agreements involve the defendant going on probation instead of being incarcerated.

If the defendant goes to trial and loses, the judge has the authority to impose any sentence within the confines of what the relevant statute permits. This is why most defendants prefer to take a plea instead of taking their chances in a trial.
