GHB is classified as a controlled substance. In Los Angeles, you can be charged with the possession, sale or intoxication of GHB. Also called Gamma Hydroxybutyric Acid, GHB has a variety of street names. It’s commonly called G, Liquid X or Liquid E.
It’s commonly used as a date rape drug, and it’s one of a few different drugs that fall in Schedule I and Schedule III categories. GHB has no known medical use and presents a high potential for abuse.
Most authorities place it in the same league as PCP, LSD, cocaine and heroin. A lot of people use GHB in a club setting, and it’s frequently combined with ketamine and ecstasy.
Possession and Selling GHB
In Los Angeles, it’s illegal to possess this substance, so if you’re caught with it, you could face possession charges. Since GHB is a Schedule I drug, the consequences for possession can be quite severe. Many individuals are caught with GHB and charged with the intent to sell the drug.
The circumstances of your situation are used to determine whether or not you intended to sell the drug. If you’re found to be in possession of GHB, and the police find baggies, scales or customer information, then you could be charged with possession with intent to sell.
A conviction for these crimes could lead to one year in county jail, probation and a $20,000 fine. Depending on the situation, you might even end up getting sentenced to four years in state prison.
Selling or Transporting GHB
A lot of people are facing charges for selling or transporting this drug. For example, some people directly supply others with the drug while inside of a club. A charge for selling the drug is self-explanatory.
If you’re convicted for either of these crimes, you could face three, four or five years in the state prison, and you could be forced to pay a fine of $20,000. The penalties for selling or transporting GHB are harsher than the penalties for possessing it.
If you’re convicted of transporting the drug across two or more California counties, you could face up to nine years in a state prison. In Los Angeles, you could be given even harsher penalties if you’re convicted of knowingly selling GHB to someone who’s pregnant, being treated for a mental disorder or has had a previous felony conviction.
Driving While Intoxicated On GHB
A lot of people are caught driving while under the influence of GHB. If this describes your situation, then a conviction could leave you facing several penalties.
The penalties for this type of conviction are the same as what’d you get from your first DUI. You might have to spend a weekend in jail, and you could lose your license for nine months.
You might also have to pay a fine of $1,000 and undergo drug counseling. If you’re convicted of driving on GHB in the future, you’ll face mandatory minimum sentences and could completely lose your license.
Seeking Qualified Legal Defense
If you’re facing any charges that involve GHB, we can help. It’s important to seek qualified legal defense because it’s the best way to protect your interest. There are several different legal defenses that we can use to help you avoid a conviction.
For example, we might be able to prove that you didn’t know you possessed the drug. If other people have used your clothing or car, there is a chance that you didn’t know the drug was in your possession. To get a conviction, it must be proven that you knew that you were in possession of a controlled substance. If you have prior drug convictions, this could be a difficult defense to use.
Maybe you’re facing charges for possession of GHB with intent to sell. If the police didn’t find any scales, cash or baggies around you, then it might be difficult to prove that you were selling the drug. To protect your interests and avoid a damaging drug conviction, contact us today.
