Can I get a Plea Bargain in a Los Angeles DUI Case?

A DUI arrest is a scary thing for people who are pulled over. Sometimes the events of the arrest can be blurry, especially if you’re outright not guilty and completely surprised by the arrest. When officers arrest you, remember that this is not a guilty verdict. It means that they suspect you were driving under the influence. Just like any other crime, you are innocent until proven guilty in a court of law. Make sure you don’t enter that court of law and plead guilty right away. By doing so, you throw away all your rights to bargain with prosecutors and have your case dismissed or reduced.

A guilty verdict comes about in two ways: Either the prosecution proves you guilty in a trial by jury or you voluntarily enter a guilty plea in court. Entering a guilty plea sometimes works to your advantage. It takes enormous resources to try a case by jury. Whenever possible, prosecutors will work with you to reduce your punishment if you enter a guilty plea. This is called a plea bargain. In exchange for your plea, prosecutors will give you a “deal” that supposedly works in your favor. If you have a veteran lawyer on your side, you’re more likely to get a better plea bargain.

Even a first time DUI can have some serious consequences. You can potentially face months in prison, inpatient alcohol rehabilitation, and fines in misdemeanor cases. In felony cases, you could face a year or more in jail, license suspension, insurance rate hikes, and much more unpleasantness that you won’t want to face. For second DUIs, the possible consequences are even heftier and more unpleasant to face. It’s no wonder that so many people accept the first plea bargain that they’re offered without even talking to a lawyer. In many cases, they might get probation and believe the nightmare is over. In reality, a good lawyer might have been able to get their case dismissed.
